Terms
This Agreement will remain in full force and effect while you use the Portal and/or are a Member. You may terminate your membership at any time and for any reason by emailing info@Dodecanesiandream.com and requesting removal of your account from our system. You will receive a confirmation email back once your account has been removed. We may terminate your membership for any reason, at any time, effective upon sending notice to you at the email address you provide in your application for membership, or such other email address as you may later provide to us. Even after membership is terminated, certain sections of this Agreement will remain in effect. See Section 20 below for a list of the provisions of this Agreement that will survive the termination of your membership.
Non Commercial Use by Member(s)
The Dodecanesiandream.com Portal is for the personal use of individual Members only and may not be used in connection with any commercial endeavors without our expressed written consent in each case. Organizations, companies, and/or businesses may not become Members and should not use the services or the Portal for any purpose unless written authorization has been obtained from Dodecanesiandream.com. You may not copy, transfer, or use any names, photos, links, text, data, or other content belonging to or posted by Dodecanesiandream.com or other Members for the purpose of selling, engaging in, marketing, or promoting any other product or service. Illegal and/or unauthorized uses of the Portal, including collecting usernames, email addresses, or other personally identifiable information of Members by electronic or other means for the purpose of sending unsolicited email, unauthorized framing of or linking to the Portal, or any other use not expressly permitted in this Agreement, will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress. In addition to the above restrictions, you may not authorize, enable, or otherwise grant to any other person, organization, company, or business access to your Dodecanesiandream.com profile or other content uploaded on the Portal for the purpose of extracting such information or other content.
Rights in Content Posted by Dodecanesiandream.com or Other Members
Dodecanesiandream.com owns and retains all proprietary rights in the Portal. All content on the Portal including but not limited to text, content, photographs, video, designs, graphics, information, software, music, sound, certain copyrighted material, including links and compilations of individual data, trademarks, and other proprietary information (“Content”) or/and (Service”), are the proprietary property of Dodecanesiandream.com, its Members or Users, or its licensors with all rights reserved. Except for any information which is in the public domain, no Content may be copied, modified, published, framed, posted, reproduced, transmitted, distributed, downloaded, performed, displayed, or sold in any form or by any means, in whole or in part, without the Company's prior expressed written consent in each case. Any use of the Portal or its Content other than as specifically authorized herein, without the prior written permission of the Company, is strictly prohibited. Such unauthorized use may also violate applicable laws of Greece and other countries including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Service shall be construed as conferring any license to intellectual property rights, whether by estoppels, implication or otherwise.
Trademarks
Dodecanesiandream.com and other Company graphics, logos, features, designs, page headers, button icons, scripts and service names are registered and unregistered trademarks, trade names, or service marks of Dodecanesiandream.com. The Company's trademarks may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of the Company. Nothing contained on this Portal grants or should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any trademarks, trade names, service marks or logos displayed on this Portal without the written permission of Dodecanesiandream.com.
Unsolicited Idea Submissions
Dodecanesiandream.com enjoys hearing from Members of the Portal community and welcomes their comments regarding Dodecansiandream.com's products and services. However, it is Dodecanesiandream.com's policy not to accept or consider ideas, suggestions, proposals or materials (whether through our feedback email, customer support email, discussion forums, or otherwise) other than those Dodecanesiandream.com has specifically requested in a separate agreement. This policy is intended to help avoid future misunderstandings when new products, services and features developed internally by Dodecanesiandream.com employees, or its associated business partners or licensors, might be similar or even identical to a Member's idea. You acknowledge and agree that any questions, ideas, feedback, proposals, or other information and materials about the Portal or Services proffered by Members or Users, including comments or suggestions sent to us at our request to improve the Portal, or to add or change a feature, are considered by Dodecanesiandream.com to be non-confidential and non-proprietary, and shall become the sole property of the Company. Dodecanesiandream.com shall have no obligations concerning the proffered item, contractual or otherwise (including but not limited to an obligation to keep the item confidential), and shall not be liable for its use or disclosure. Dodecanesiandream.com shall own exclusive rights, including all intellectual property rights, and shall be entitled to unrestricted use and dissemination of these proffered items for any purpose whatsoever, commercial or otherwise, without acknowledgement or compensation to the Member or User.
Members Submissions
The purpose of DodecanesianDream.com portal is to collect heritage documents and information referring to the Dodecanese Diaspora and to make them available to all who may be interested in them, thus helping to keep alive the memories and experiences of others. By publishing them here you are making them available world-wide. Portions of this Portal may allow users to post their own material. Reviews are to be written and shall be published only in English or Greek.
By submitting any content to DodecanesianDream.com, you verify and warrant that:
1. you are the sole author and owner of the intellectual property rights thereto;
2. all "moral rights" that you may have in such content have been voluntarily waived by you;
3. all content that you post is accurate;
4. use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.
For any content that you submit as your own, you grant DodecanesianDream.com a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
If you submit any photographs, graphics, video or audio your entries remain your own properties over which you retain the copyright.
By submitting your materials you agree to grant DodecanesianDream.com the right to display it on the Portal and to use it for the purposes of promoting the Portal such as in exhibitions and lectures and, should such a publication eventuate, to include it in a printed collection of entries from the site, in which case the author/submitter will be acknowledged in writing.
DodecanesianDream.com has no obligation to credit you in any manner for any use of the Submission, but May, without any further consent, include your name and hometown with any use made of the Submission. Such possible acknowledgement is your sole consideration for the Submission.
If you do not want to grant to DodecanesianDream.com the rights set out above, please do not submit your materials (photographs, graphics, video or audio) to DodecanesianDream.com.
All contents that you submit may be used at DodecanesianDream.com’s sole discretion. DodecanesianDream.com reserves the right to change, condense or delete any content on DodecanesianDream.com website that DodecanesianDream.com deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use.
Submissions are generally posted within 72 hours.
However, DodecanesianDream.com reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not DodecanesianDream.com, are responsible for the contents of your submission. None of the contents that you submit shall be subject to any obligation of confidence on the part of DodecanesianDream.com its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.
Users should not use false e-mail addresses, impersonate others or in any way mislead as to their identity.
Contributors under the age of 18 should get the permission of a parent or guardian before submitting to any section of DodecanesianDream.com. Never reveal any personal information about yourself (for example, your telephone number, home address or email address) in any of your submissions.
If you choose to remove your User Content, the license granted above will automatically expire.
Prohibited Content
Below is a partial list of the kind of Content that is illegal or prohibited on the Portal. Posting of any of this Content by you may, in our sole discretion, result in termination of your membership. In addition, we reserve the right to investigate and take appropriate legal action, in our sole discretion, against anyone who violates this provision, including without limitation, removing the offending communication from the Portal and reporting such violators to the appropriate legal authorities. We will fully cooperate with any law enforcement authorities or court order or subpoena requesting or directing us to disclose the identity of anyone posting such materials.
Prohibited Content includes, but is not limited to, Content which, in our sole judgment:

h. provides or includes material that exploits people under the age of 18 in a sexual or violent manner, or is intended to solicit personal information from anyone under 18;
i. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
j. solicits passwords or personally identifying information for commercial or unlawful purposes from other Members or Users;
k. engages in, constitutes, or includes any promotion, sales or other commercial activity without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes; or
l. solicits people you don't know to add you or accept you as a friend on the Service.
Even though all of the above Content is strictly prohibited, there is a small chance that you might become exposed to such items while using the Portal. If so, then neither we, nor any of our owners, officers, directors, employees, shareholders, advertisers, or corporate partners will be in any way responsible for any damages (to or from any party) related to any such exposure.
Registration and Password
As part of your registration process, you may be asked to select a password.

Indemnity
You agree to indemnify and hold the Company, its subsidiaries, affiliates, officers, directors, agents, contractors, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, arising out of any claim, action, investigation, or proceeding made or instituted by any third party due to or arising out of your use of the Portal or Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party. Governing Law, Venue, and Jurisdiction
By visiting or using the Portal, you and Dodecanesiandream.com agree that the laws of Greece without regard to principles of conflict of laws will govern these Terms of Use and any dispute of any sort that might arise between you and the Company or any of its affiliates.
You and Dodecanesiandream also agree and hereby stipulate and hereby submit to the exclusive personal jurisdiction and venue of the Rhodes Regional Court, over all claims, and that such claim will be adjudicated under the laws of the country of Greece with respect to such matters. Except that, to the extent you have in any manner violated or threatened to violate the Company's or any of its affiliates' proprietary or intellectual property rights, we may seek injunctive or other appropriate relief in any regional supreme court of competent jurisdiction.
The Dodecanesiandream.com portal is intended for use only within Greece. Dodecanesiandream.com makes no representation that materials on this website are appropriate or available for use in other locations. Those who choose to access this website from other locations do so on their own initiative and are responsible for compliance with foreign and local laws.
Any claim, action or proceeding by you related in any way to the Portal and/or the Service (including your visit to or use of the Portal and/or the Service) must be instituted within one (1) year after the cause of action arose or be forever waived and barred.
Survival
Although this Agreement may be terminated by you or us at any time and for any reason, the terms of the following sections of this Agreement will survive any such termination, and you and we will continue to be bound by such terms indefinitely: Section 3 (Terms), Section 5 (Rights in Content Posted by Dodecanesiandream.com or Other Members), Section 7 (Unsolicited Idea Submissions), Section 8 (Members Submissions), Section 14 (Member Disputes), Section 16 (Disclaimers), Section 17 (Limitations on Liability), Section 18 (Indemnity), Section 19 (Governing Law, Venue, and Jurisdiction), Section 20 (Survival), and Section 21 (Other).
Other
By using the Dodecanesiandream.com, or becoming a Member, you will be deemed to have accepted the terms of this Agreement. These Terms of Use, together with the Privacy Policy and any other policies of the Company posted by us on the Portal, constitute the entire agreement between you and the Company regarding the use of the Portal and/or the Services, superseding any prior agreements between you and the Company relating to your use of the Portal or the Service. The failure of the Company to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
